In these conditions Gormleys Auctions, who act as auctioneers and agents for the vendor are called "the auctioneers" (which expression shall be deemed to include their servants and agents) and the representative of Gormleys conducting the auction is called "The Auctioneer":

  • While reasonable care is taken to ensure the accuracy of descriptions of lots offered for sale, such descriptions, whether in advertisements, brochures, catalogues, write-ups, literature or any other form of audio or visual communication published or produced by or on behalf of the auctioneer are not, and shall not be taken to be, statements of fact or representations in relation to any such lot. They are statements of the opinion of the auctioneer. Furthermore comments and opinions which may be found in or on lots in labels, notes, catalogues prices, lists or that are expressed by any other means shall not constitute part of the description of the lot unless expressly stated by the auctioneers.
  • Each lot is offered for sale and the highest bidder for each lot upon the fall of the hammer shall be the buyer. If any dispute should arise as to who is the highest bidder, the auctioneer shall have absolute discretion to determine the dispute and may put up again and the lot re-sold in respect of which the dispute arises. Each lot knocked down to a buyer at the auction shall be and remain at the buyer's risk.
  • The auctioneer acts as an agent only in the sale of any lot and therefore shall not be liable for any default of the buyer or vendor. The conduct of the auction shall be at the sole discretion of the Auctioneer who may also bid on behalf of the vendor or any of the Auctioneer's clients but without any liability for errors of commissions in executing such arrangements or instructions.
  • Each lot shall be at the buyers risk from the fall of the hammer and shall be paid for in full and taken away at their expense.
  • If any buyer fails to pay in full for any lot within 7 days, such lot may at any time thereafter at the auctioneer's discretion, be put up for sale by auction again or sold privately.
  • All lots are made available for inspection for a reasonable period prior to the auction. A buyer who makes a bid for any lot thereby acknowledges that he has satisfied himself as to the physical condition, state of repair or restoration, age and catalogue description of such lot and also that he accepts these conditions of sale.
  • The buyer shall pay artist resale rights where applicable. Artist resale rights are applicable to all works of a living artists and artists who are deceased less than 70 years that reach a hammer price over €1,000 at a rate of up to 4%.
  • The buyer shall pay the auctioneer a commission of 22.5% of the hammer price. VAT is payable only on the commission at the prevailing rate.

Any artwork purchased may be collected in person from either our Belfast or Dublin galleries for no extra charge once funds have cleared (payment on collection is also an option).

Should you wish to have work delivered, we are happy to provide a quote for local, national, and international delivery.

All artwork is carefully packed and sent via an insured courier and should reach you in perfect condition.

We advise sending artwork without glass. If the piece is glazed, you will be advised of the cost of removing it or it can be sent with glass at your own risk.

Delivery Time

Please allow five working days for delivery to the UK and Ireland. For international deliveries please allow seven to ten working days from receipt of payment.

We accept payment by the following methods:

  • Credit or debit card (In one of our galleries, online or over the phone)
  • Bank transfer (Please request our bank details)
  • Cheque (In one of our galleries or via post. Goods will not be released until the funds have cleared into our account)
  • Cash (In one of our galleries)

Bidding Online
Gormley's Auctions do not charge any additional fees for bidding online. We do ask however that all customers pay particular attention to our payment and collection terms. If buying online it is the purchasers responsibility to make sure that they have satisfied themselves with the condition of the lot and if applicable any frame it may have.

We offer two forms of online bidding; pre auction bidding and live auction bidding. Both require you to register at www.gormleysartauctions.com

Pre-auction Bidding
This feature allows customers to place bids on any lots before the live auction starts. You will be asked to enter your maximum bid with the highest amount you would be willing to pay for the item. Gormley's Auctions will automatically raise your bid only as much as is needed for you to remain the high bidder. This means that you may win an item for less than your maximum bid, but you can also be outbid if someone else enters a higher maximum bid. Your maximum bid will not be disclosed.

If you are the first person to place a bid you will be asked to enter a minimum bid unless the item is unreserved. The minimum bid will always be lower than or at the reserve. Once you have entered your maximum bid you can increase it at any stage up until 5 minutes before the start of the auction.

If you maximum bid matches that of an in room bidder, precedence will go to the in-room bidder. It is often the case that winning bids are odd amounts. Therefore by placing a bid of 1,100 you are much more likely to win than placing a bid of 1,000.

Live Online Bidding
This feature allows customers to bid on each lot in the same manner as someone in the room would. Lots are offered for sale in numerical order as they appear in the catalogue and on our website according to their lot number.

There is no maximum bid when using this feature; the only option is the next pre assigned bid. Bidding increments will be as follows: 0-200 by 10, 200-500 by 20, 500-1300 by 50 and over 1300 by 100, however the auctioneer can deviate from this at his discretion and this will be reflected in the next available bid.

Once a bid has been place it will have to be approved. If another online bid of the same amount is entered precedence will go to the bid first submitted and any unsuccessful bidder will be asked to bid again. If your bid is accepted you will be notified that you are the current highest bidder, if you are out bid you will have the option to bid again and if you win the lot you will be notified that you have won.

When viewing the auction online you will see the “Fair Warning” notice appearing on each lot, this denotes that that the lot is about to sell. Once this notice appears you will typically only have a few seconds to place your bid. Please note any bids that are received after the fall of the hammer will not be accepted.

Buyer's Premium
The buyer shall pay the auctioneer a commission of 22.5% of the hammer price. VAT is payable only on the commission at the prevailing rate. 

Bidding Increments
Bidding increments will be as follows: 0-200 in 10s; 200-500 in 20s; 500-1300 in 50s; 1300-4000 in 100s; over 4000 in 200s. However, during a live sale the auctioneer can deviate from this at his discretion.
